An Illinois Senate subcommittee says the rules for outdoor smoking at bars and restaurants are lacking clarity. Some business owners are criticizing the Illinois Smoke Free Air Act, saying it doesn't address smoking in beer gardens. The panel wants the Illinois Department of Public Health to work with the state Joint Committee on Administrative Rules, or JCAR, to adopt language that would put teeth in the law. Senator Dave Koehler says both groups failed to finalize rules on the law after it passed in 2008: "It was just a stalemate, and so what are private business owners supposed to do then when all of a sudden they don't know what the rules are and how to comply with them?,” Koehler says.
Koehler says he’s filed bill that would allow smoking on outdoor locations under specific guidelines. Koehler’s legislation will likely be introduced in the fall veto session if there’s no agreement on the smoking ban rules.
